1. Eligibility

VETERAN INK (“Tattoo of the Month Contest”) is open only to legal residents of the fifty (50) United States and District of Columbia who are at least eighteen (18) years of age at the time of entry. No purchase is necessary to enter. Making a purchase will not increase your chance of winning. VETERAN INK’s contests are void in Canada, Puerto Rico, and where prohibited by law. Eligible entrants are those who are Veterans and/or Active Service members of the military. Trustees, Board Members, Employees, interns, or partners, as well as the immediate family (spouse, parents, siblings, and children) and household members of those employees, are not eligible to enter. All applicable federal state, and local laws and regulations apply.

2. Sponsor

The Contest is sponsored by VETERAN INK, LLC, located at 1124 Bay Blvd., Ste. B, Chula Vista, California 91911.

3. Agreement to Official Rules

Participation in the Contest constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding. Winning a prize is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein. All entrants hold the Sponsors and their respective regents, directors, officers, employees, emeriti, fellows, interns, research associates, and volunteers (the “Indemnified Parties”) harmless from and against all claims of any nature arising in connection with entrant’s participation in the contest and acceptance or use of a prize. The Indemnified Parties are not liable for any costs, damages, injuries, or other claims incurred as a result of entrants’ participation in the contest or winner’s acceptance and usage of a prize. The Indemnified Parties are not responsible for incomplete or misdirected entries, technical or network malfunctions or failures, or causes beyond their control. Entrants are solely responsible for their entries. Entrants may not submit materials that introduce any software viruses, worms or other programs designed to damage software, hardware or telecommunications equipment or are off-topic, partisan-political, contain advertising, nudity, personal attacks or expletives, or is otherwise abusive, threatening, unlawful, harassing, discriminatory, libelous, obscene, false, sexually explicit, or that infringes on the rights of any third party.

VETERAN INK reserves the right to cancel the contest or modify these rules at its discretion. In the event of a dispute regarding the winner, VETERAN INK reserves the right to award or not award the prizes in its sole discretion. VETERAN INK reserves the right to disqualify any entrant whose entry or conduct appears in any way to: inhibit the enjoyment of others; tamper with the competition; violate these rules or other applicable law or regulation; infringe on the rights of third parties; or act in an unsportsmanlike or disruptive manner. Decisions of VETERAN INK are final and binding.

5. How to Enter

All images must be submitted through our website submission application, including all required fields, including name, email and other information about your submission.
Digital images from your desktop, phone, tablet, or other electronic device are eligible. We will not accept links to photos or images stored on third-party websites (i.e. Facebook, Twitter, Instagram, etc…).
You may enter an unlimited number of times, but you may not use an agency or automated system to enter. Sponsor reserves the right to reject any additional entries or entries that do not comply with these Official Rules. By entering, you indicate your unconditional agreement to, and acceptance of, these Official Rules and Sponsor’s decisions, which are final and binding. You cannot win a prize unless you comply with all requirements in these Official Rules.

6. Image Eligibility

To ensure eligibility for the contest, please submit files no larger than 5MB at the time of entry. Higher resolution files of at least 240 dpi/ppi will be requested should an entry be preselected to be awarded a prize or an honorable mention. All images should accurately reflect the subject matter and the scene as it appeared. Photos that have been digitally altered, beyond standard optimization (removal of dust, cropping, reasonable adjustments to exposure, color and contrast, etc.) will be disqualified.
Entries may originate in any format — including, but not limited to digital files, digital prints, color transparencies, color prints, or black and white prints — so long as they are submitted electronically in a .JPEG .jpg, or .png format. Multiple exposures that have been combined to produce a single “High Dynamic Range” image are acceptable.
Previously published material, for which non-exclusive rights were granted, may be entered as long as you still maintain the right to grant us a license (see “Your Rights” below). You must be able to disclose when and where the photo appeared previously to The Nature Conservancy upon request.

7. Prize Drawing

The Sponsor will select a potential winner based off several criteria: The story associated/behind the contestant’s tattoo and based on the Design and quality if the tattoo workmanship. The odds of being selected depend on the number of entries received. The Sponsor will attempt to notify the potential winner via telephone or email once a winner has been selected. If the potential winner cannot be contacted within five (5) days after the date of the first attempt to contact him/her, the Sponsor may select an alternate potential winner in his/her place at random from the remaining non-winning, eligible entries.
VETERAN INK Staff has the right to overlook any judging criteria and/or disqualify a contestant if we feel that the submitted image is plagiarized.

8. Winner Notification

The potential winners will be notified by email, mail or phone. Each potential winner will be required to complete, electronically sign and submit a Declaration of Compliance within five (5) days of the date notice or attempted notice is sent, in order to claim his/her prize. If a potential winner cannot be contacted, or fails to submit the Declaration of Compliance within the required time period (if applicable), or the prize is returned as undeliverable, the potential winner forfeits the prize.

If the potential winner is at least 18 but still considered a minor in his/her jurisdiction of residence, Sponsor reserves the right to award the prize in the name of his/her parent or legal guardian, who will be required to sign the Declaration of Compliance on the potential winner’s behalf and fulfill any other requirements imposed on winner set forth herein. Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. Only three (3) alternate drawings will be held, after which the prize will remain un-awarded. Prizes will be fulfilled approximately one (1) week after the conclusion of the Contest.

9. Prizes

We will select one (1) winner every two (2) weeks for a free t-shirt.

10. General Conditions

In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including, but not limited to fraud, virus, bug, worm, unauthorized human intervention or other technical problem, or in the event the Contest is unable to run as planned for any other reason, as determined by Sponsor in its sole discretion, the Sponsor may, in its sole discretion, either (a) suspend the Contest to address the impairment and then resume the Contest in a manner that best conforms to the spirit of these Official Rules or (b) terminate the Contest and, in the event of termination, award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages (including attorney’s fees) and any other remedies from any such person to the fullest extent permitted by law. Failure by the Sponsor to enforce any provision of these Official Rules shall not constitute a waiver of that provision.

11. Release and Limitations of Liability

By participating in the Contest, entrants agree to release and hold harmless the Sponsor, and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Contest, and each of their respective officers, directors, employees, shareholders, representatives, and agents (the Released Parties) from and against any claim or cause of action arising out of participation in the Contest or receipt or use of the prize (including any travel or activity related thereto), including, but not limited to: (a) any technical errors associated with the Contest, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Contest; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d) application downloads, (e) any other errors or problems in connection with the Contest, including, without limitation, errors that may occur in the administration of the Contest, the announcement of the winner, the cancellation or postponement of the event and/or the flyover, if applicable, the incorrect downloading of the application, the processing of entries application downloads or in any Contest-related materials; or (f) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrants participation in the Contest or acceptance, receipt or misuse of the prize (including any travel or activity related thereto). Entrant further agrees that in any cause of action, the Released Parties liability will be limited to the cost of entering and participating in the Contest, and in no event shall the entrant be entitled to receive attorney’s fees. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

12. Your Rights

You will retain all ownership of any photograph you submit. However, if you submit an image to VETERAN INK website to enter into the said contest, you grant VeteranInk.com a royalty-free, non-exclusive right during and after the contest to:

    • 12.1 Display the photograph on the VETERAN INK submission website

    • 12.2 Display your photograph, but not limited to advertising materials, electronic or print publications, email marketing campaigns, and videos.
    • 12.3 Allow third-parties to share the photograph on the following social media platforms: Twitter, Facebook, and Pinterest.

If your photograph is formally honored by the competition as a winner or an honorable mention, you grant VETERAN INK (www.VeteranInk.com) a royalty-free, exclusive right, in perpetuity, to:

    • 12.4 Use the photograph on the Internet and in Social Media in support of our mission.
    • 12.5 Use the photograph in VETERAN INK’s internal and external communications materials including but not limited to web sites and web publications, fact sheets, fund raising publications, advertising, multimedia, presentation and membership services, annual report and Veteran Ink’s magazine.
    • 12.6 Provide your photograph to other individuals and organizations for Conservancy-related use in news stories, newsletters, reports, slide shows, displays, web pages, videos, membership premiums, and the like.
    • 12.7 Use, in connection with the VETERAN INK, your name, city, state and country of residence in promotions and other publications.
    • 12.8 Retain a digital copy of your photograph submission that will be archived in the VETERAN INK photo library and accessible to VETERAN INK staff via the VETERAN INK internal online photo archive.

The VETERAN INK will endeavor to credit all images with the caption “Person’s Name” when the full name is available.

13. Disputes

Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in California. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants rights and obligations, or the rights and obligations of the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of California, without giving effect to any choice of law or conflict of law rules (whether of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than California.

14. Privacy and Publicity

Any information you submit as part of the VETERAN INK will be used in accordance with Sponsor’s Privacy Policy. The information you provide when you enter is provided to Sponsor, not to any social media. Except where prohibited, you consent to Sponsor’s use of your name in any list of winners (if applicable) and for promotional purposes in any form of media without further payment or consideration.
